Welcome to our platform! Our Terms and Conditions outline the rules and regulations for the use of our website. By accessing this website, we assume you accept these terms and conditions. Please read them carefully. Your use of this website indicates your agreement to abide by these terms and conditions.
1. Booking your Holiday
• Contract: Your holiday contract is with Trek De Kashmir , registered in Jammu and Kashmir. These terms and conditions apply to all bookings.
• Correspondence: The address provided on the booking form will be used for all correspondence related to your booking.
• Deposit: A minimum deposit of 20% of the total booking cost is required to initiate the booking process. However, this does not guarantee confirmation until Trek De Kashmir issues an official acknowledgment.
• Payment Schedule:
- Full payment must be made at least 15 days before the travel date.
- Bookings made within 30 days of the travel date require full payment at the time of booking.
- For flight ticket bookings, 100% advance payment is mandatory.
• Failure to Pay: If full payment is not received within the specified time, the booking will be canceled without notice, and the advance payment may be forfeited.
• Client Responsibility: Clients must provide accurate details, including any specific preferences (dietary, medical, etc.) on the booking form.
2. Payment Policy
• Breakdown of Payments:
- 20% deposit payable at the time of booking.
- The remaining 80% must be paid in installments, completed at least 15 days prior to travel.
• Surcharges: If applicable, surcharges due to changes in taxes, fuel prices, or government policies will be communicated to clients, and the updated price must be paid before final confirmation.
3. Price Policy
- Prices are valid for specific dates and are subject to change without prior notice.
- Trek De Kashmir is not obliged to provide a breakdown of expenses.
- Price fluctuations caused by exchange rates, government-imposed taxes, or fuel surcharges will require the client to pay the updated amount before the trip confirmation.
4. Cancellation Policy
• Provided that Trek De Kashmir receives written notice, you are entitled to cancel your vacation at your discretion. However, Cancellation charges will apply as follows:
• Cancellation Charges:
- ₹2,000 per person as a basic cancellation charge.
- 30 days or more before departure: ₹2,500 per person or 50% of the total cost (whichever is higher).
- 29–15 days before departure: 75% of the total tour cost.
- 14–1 day before departure: 100% of the total tour cost.
• Flight Tickets: Cancellation charges for flight tickets will be as per the airline’s policies.
• No Show: No refund will be provided for no-show bookings.
• Important Notes:
- GST on the invoice is non-refundable.
- Unused services or incomplete tours are non-refundable.
- Failure to pay two consecutive installments on time will result in cancellation and forfeiture of the advance amount.
5. Changes by Trek De Kashmir
• Trek De Kashmir reserves the right to modify or cancel any travel plan due to unavoidable circumstances.
• Client Options in Case of Changes:
- Accept the changes.
- Opt for a replacement package of equal or lesser value.
- Postpone the trip (compensation may apply).
• Changes due to force majeure (natural calamities, war, strikes, etc.) will not be compensated.
6. Health Guidelines and Safety
• Travel to Ladakh:
- Children below 2 years and individuals with heart conditions, asthma, or other critical illnesses are not advised to travel to Ladakh.
- Senior citizens must consult their physician before travel.
• Alcohol: Avoid consuming alcohol on the first day of arrival at high-altitude destinations.
• Waiver of Responsibility: All clients must sign a waiver acknowledging risks associated with specific excursions and agreeing to act with caution throughout the trip.
7. Departure Flight Policy
- PNR details will be provided 48 hours after full payment is received.
- Departure tickets will be issued 5 days before the travel date.
- Trek De Kashmir is not responsible for flight schedule changes or cancellations made by airlines. Tickets are non-refundable and non-changeable.
8. Additional Inclusions & Exclusions
• Gondola rides, union cabs, and activities at destinations like Gulmarg, Sonmarg, Pahalgam, and Doodhpathri are excluded unless specified in the booking confirmation.
9. Natural Disasters and Force Majeure
- Trek De Kashmir is not liable for disruptions caused by natural disasters (e.g., landslides, floods, snowfall) or road closures, including National Highway 44 (Jammu to Srinagar).
- In such cases, clients may need to shift to nearby accommodations, and all additional expenses will be borne by the client.
- Trek De Kashmir will assist in finding alternate arrangements, but the client will be responsible for any extra charges incurred due to such unforeseen circumstances.
10. Complaints & Dispute Resolution
- During the Trip: Any issues must be reported immediately to the local representatives or Trek De Kashmir headquarters for resolution.
- Post-Trip Complaints: If unresolved, complaints should be submitted in writing within 28 days of trip completion, along with the booking reference number.
- All disputes will be governed by Indian law and will be subject to the jurisdiction of courts in Jammu and Kashmir.
11. Data Protection Act
• TREK DE KASHMIR might need to request specific personal data from you. Dietary restrictions, physical conditions, disabilities, and religious knowledge are a few examples of this. You can review this information during TREK DE KASHMIR's regular business hours, and the organisation promises to keep it private. If the suppliers need to know this information in order to complete the contract that TREK DE KASHMIR has with you, then they will get it.
12. Disclaimer
• Trek De Kashmir does not own or operate the transportation, lodging, or other services used during the trip. The company is not responsible for any errors, omissions, or changes made by third-party service providers.
13. Important Notes
- Once hotel confirmation vouchers are issued, no changes in bookings will be entertained.
- Travelers are responsible for carrying all valid documents, including passports, visas, and medical insurance.
- Trek De Kashmir holds no liability for any loss, injury, or unforeseen circumstances caused during the tour.
14. Waiver
• All clients must sign a "Waiver of Responsibility" form acknowledging the risks associated with specific excursions.
