1. Booking your Holiday

• Your holiday contract is with TREK DE KASHMIR, registered in Jammu and Kashmir, and these terms and conditions apply to all bookings
• The address provided on the booking form will be the one to which TREK DE KASHMIR sends all correspondence regarding your vacation.
• All reservations must be made by TREK DE KASHMIR, a representative with authorization. A 50% deposit of the total booking cost must be paid at the time of booking, together with the completion and submission of the TREK DE KASHMIR booking form.
• TREK DE KASHMIR does not suggest or promise that the reservation has been confirmed only because they have received the deposit and booking form. Bookings cannot be verified until TREK DE KASHMIR sends out a formal notification. TREK DE KASHMIR retains the right to reject a reservation for any reason, in which case the money will be refunded.
• The entire cost of your vacation must be paid at least 30 days prior to the departure date. TREK DE KASHMIR has the right to cancel the reservation and keep the money if payment is not received by the deadline. The booking form's signatory warrants payment of the whole sum indicated therein in compliance with these terms. The signature bears the duty of guaranteeing that TREK DE KASHMIR is paid in full by the deadline. Reminders won't be sent out.
• If you make a reservation less than 30 days before your travel, full payment must be provided at the time of booking.
• Please provide any specific preferences, including dietary needs, on the reservation form.
• The service shall be rendered by TREK DE KASHMIR exactly as described and verified in writing.
• Union cabs, gondola rides, and other activities at the destination, such as Gulmarg, Sonmarg, Phalagam, and Doodhpahri, are not included in the package until you have written confirmation from TREK DE KASHMIR in the form of a confirmation letter.

2. Price Policy

• TREK DE KASHMIR is not required to provide a breakdown of the expenses associated with a vacation.
• Before accepting your reservation, TREK DE KASHMIR retains the right to warn you of any pricing increases.
• Unless you pay for your vacation in full at the time of booking, the price of your vacation is subject to the possibility of surcharges under specific, restricted situations when TREK DE KASHMIR issues a confirmation invoice. However, a surcharge will only be imposed to account for variations in the cost of transportation, such as fuel prices, increases in regularly scheduled published airfares, taxes or fees associated with services like landing taxes at airports, changes in the exchange rate that applies to the specific package, or tax increases imposed by the government or a regulatory body.
• You have the option to pay for your vacation in full at the time of booking, in which case the price of your vacation will be set at the amount the company quotes you at that time.
• You must send the Confirmation Invoice to TREK DE KASHMIR with complete payment within five days of the date written on the invoice in order to be eligible for this incentive.

3. Cancellation and Changes by the Company

• TREK DE KASHMIR has the right to modify your vacation plan at any time and will notify you of any changes as soon as they occur. On rare occasions, it may be essential to make alterations. If there is a significant alteration to your trip that is required, and it is not due to events beyond of TREK DE KASHMIR's control, you have the following options:
  • To agree to the new schedule.
  • To buy another vacation package from us.
  • To postpone your vacation. In the event of a significant change, compensation can be due as explained below.
• Modest alterations will not be reimbursed. Minimal alterations to the aircraft type, departure and arrival timings, and the quality of the dining establishments and lodging are all considered minor modifications.
• Significant modifications encompass cancellation, alteration of your INDIA airport, departure or return delays over 12 hours, and substitution of a lower-quality lodging.
• Changes or cancellations brought about by Acts of God (Force Majeure), war, the threat of war, riots, civil strikes, labour disputes, terrorist activities, natural or man-made disasters, fire, transportation-related technical issues, airport closures or congestion, strikes or other industrial action, unfavourable weather conditions, or any other uncontrollable event will not be reimbursed by TREK DE KASHMIR. It is imperative that you get sufficient travel insurance.
• TREK DE KASHMIR has the right, even after sending a confirmation notification, to cancel your vacation at any point prior to the departure date. TREK DE KASHMIR will reimburse you in full for any money you have already paid if your vacation is postponed. There won't be any payment due.
• The carrier's conditions of carriage, some of which may exclude or restrict responsibility, apply to transportation. These terms, which apply to your vacation trip, are often covered by international agreements between nations and are typically listed on the carrier's tickets.
• TREK DE KASHMIR has the right to refuse anyone from the tour if they believe that person could jeopardise the health, safety, or enjoyment of others on the tour. If you do not pay the remaining balance of the holiday price at least 30 days prior to departure, TREK DE KASHMIR will treat the booking as cancelled and levy the cancellation charges listed below.
• TREK DE KASHMIR's exclusive liability and the client's exclusive recourse in any of the aforementioned situations are restricted to a refund of any money paid, minus the cost of services already rendered and administrative costs.

4. Cancellation and Changes by You

• Provided that Trek De Kashmir receives written notice, you are entitled to cancel your vacation at your discretion. However, all cancellations will incur the following charges:
  • 30 days or more prior to departure: Loss of deposit.
  • 15-29 days before departure: 30% of tour cost.
  • 7-14 days before departure: 50% of tour cost.
  • 6 or fewer days before departure: 80% of tour cost.
  • 48 hours or fewer before departure: 100% of tour cost.
• Once the itinerary has been confirmed, the client may make one set of changes without facing any additional fees. However, the client will remain liable for any additional expenses resulting from the changes, including but not limited to extra airfare, lodging, etc.

5. Our Responsibilities

• TREK DE KASHMIR does not own or operate the aeroplanes, lodging, dining establishments, or other establishments utilised in connection with the planned trips. Despite taking great care when choosing travel, lodging, dining, and other service providers, TREK DE KASHMIR has not had the chance to inspect any of these establishments and does not imply that any restaurants, lodging, travel, or other services have been examined.
• TREK DE KASHMIR disclaims all liability for any death, illness, or injury that you or any member of your party may sustain as a result of our contract's failure to perform or improper performance in any situation where the failure can be attributed to any party member's actions or inactions, actions of a third party unrelated to the provision of your vacation, or an unforeseen event that neither TREK DE KASHMIR nor the service provider could have reasonably been expected to foresee or prevent.
• TREK DE KASHMIR will not be liable for any illness, damage, or death that occurs to any member of your party as a result of an activity that is not included in the vacation that the company has planned for you. When necessary, TREK DE KASHMIR will provide general help.
• TREK DE KASHMIR regrets that unless a refund can be secured from the carrier or supplier, no refunds will be given for unused tickets where travel, sporting events, or other sorts of tickets are concerned.

6. Your Responsibilities

• Though a suitable coverage might be included in your vacation package, you are in charge of securing your own travel insurance. The booking form requires the details of every insurance policy that each member of your group possesses. If there is insufficient evidence that personal insurance have been set up, no booking forms will be accepted. Please confirm that the activities you are booking—which are verified on the Confirmation Invoice—are covered by your insurance policy.
• Every traveller in the group has to have a current passport, visa, and all required paperwork for the countries they are visiting. TREK DE KASHMIR disclaims all liability for any costs or delays resulting from incomplete or misfiled documentation.
• It is your responsibility to be on time for flights, check in, and pick up all of the pre-arranged parts of your vacation. TREK DE KASHMIR disclaims any liability for customers' missed flights due to delayed check-ins. If you choose not to use any portion of your vacation, you will not get credit or reimbursement. Travel papers that are misplaced, damaged, or lost will not be credited or refunded.
• When you reserve a vacation with TREK DE KASHMIR, you agree to act civilly, not interfere with other people's enjoyment of their vacation, and not do any action that might damage TREK DE KASHMIR's reputation. Should you violate this provision, TREK DE KASHMIR shall immediately end your vacation and be under no further contractual duty to you. TREK DE KASHMIR shall be entitled to reimbursement for any damages incurred from the person who signed the booking form and/or the infringing party.
• Any prior medical issues that any members of their party may have must be disclosed by the individual signing the booking form.
• All personal belongings and equipment are the owner's responsibility at all times. TREK DE KASHMIR disclaims any liability for any delay, damage, or loss to your belongings or luggage unless it is specifically the result of one of our agents' carelessness.

7. Smoking

TREK DE KASHMIR prohibits smoking in any of its fleet vehicles. For individuals who would want to smoke, frequent stops can be scheduled. Unless the customer requests a smoking room directly, all accommodations will be reserved with non-smoking rooms. Confirmation is contingent upon hotel capacity./p>

8. Waiver

TREK DE KASHMIR will make every effort to guarantee the client's safety during the tour; nonetheless, there may be some risk involved with each specific excursion. Before starting their trip, clients should be ready to complete a "Waiver of Responsibility" form. By signing this form, clients acknowledge that they must always use caution and good discretion to protect both their own safety and the safety of other visitors.

9. Disclaimer

TREK DE KASHMIR has taken every precaution to ensure that the information on our website is accurate. However, TREK DE KASHMIR disclaims all liability for any mistakes or omissions that may occur on this website.

10. Complaints

• Please notify the appropriate airline, hotel, local agency, or other suppliers as soon as possible if you experience an issue while on vacation so that they may try to make things right. You need to get in touch with the TREK DE KASHMIR headquarters so they can offer assistance if you are unable to overcome the issues. TREK DE KASHMIR shall not be liable for failure to complete an itinerary due to events beyond of their control or for failing to notify them of a problem in time for them to take corrective action. Within 28 days of returning home, you should write to TREK DE KASHMIR with your original booking reference number and any other pertinent information, in the unusual case that a complaint cannot be handled at that time. Any claim you may have for compensation may be diminished or nullified if you neglect to perform any of these actions, which will also make it more difficult for TREK DE KASHMIR to resolve any issues and/or conduct a thorough investigation.
• Any potential disagreement will be handled under Indian law, and both parties agree to submit to the courts in India.
• To the best of TREK DE KASHMIR's knowledge, all information—whether provided verbally or in writing—is believed accurate at the time of giving and is provided in good faith. All additional warranties and conditions are superseded by the terms and conditions of the booking.

11. Data Protection Act

TREK DE KASHMIR might need to request specific personal data from you. Dietary restrictions, physical conditions, disabilities, and religious knowledge are a few examples of this. You can review this information during TREK DE KASHMIR's regular business hours, and the organisation promises to keep it private. If the suppliers need to know this information in order to complete the contract that TREK DE KASHMIR has with you, then they will get it.

12. Choice of Law and Dispute Resolution

The parties agree to submit to the jurisdiction of the federal courts of the State of California, and these Terms shall be governed by and interpreted in conformity with the laws of the State of California, without regard to considerations of conflict of laws. In any such action or process, each party hereby irrevocably submits to the jurisdiction and venue of any such court. These Terms shall not be governed by the United Nations Convention on Contracts for the International Sale of Goods.
